Claims due by March 1 for Your Share of the TikTok Data Privacy Settlement

DDP reported in October 2021 on the $92 million TikTok data privacy settlement. Now, the deadline for submitting a claim is coming up in 2 weeks, or by March 1, 2022.

What was this lawsuit about?

Plaintiffs sued TikTok claiming that they harvested and profited from consumers’ private information, including their biometric data, geolocation information, personally identifiable information, and unpublished digital recordings, through the TikTok App. Defendants deny that they did anything wrong.

How much money will I get if my claim is approved?

At this point, it is almost impossible to determine how much each approved Claim will receive, as it depends on (1) how much of the $92 million is left for the Class after paying class administration costs and the attorneys’ fees, (2) how many of the estimated 89 million members of the class submit claims that are approved, and (3) how many of the estimated 1.4 million Illinois class members submit claims that are approved.

However, making some simple assumptions shows that each non-Illinois resident should receive $9 per approved claim, and each Illinois resident should receive $54 per approved claim.

[Assumptions made on this Allocation: (1) $60 million of the $92 million will remain to distribute to the class, (2) between 6% and 7% of the estimated 89 million nationwide members will submit approved claims (or roughly 6 million people), and (3) between 6% and 7% of the estimated 1.4 million Illinois residents will submit approved claims (or roughly 100,000 Illinois residents].

How do I know if I am eligible?

The eligibility criteria are simple and straightforward. If you:

  1. lived in the United States,
  2. used the “TikTok – Make Your Day” video-sharing application,
  3. prior to September 30, 2021,

then you are eligible to submit a Claim!

If you were a resident of Illinois and used TikTok to “create videos while living in Illinois”, then you are eligible for a 6X payout. So if non-Illinois residents were to receive $9, then Illinois residents would receive $54.

How do I submit a Claim?

The easiest way to submit a Claim is to do so online here. It asks if you have a Notice ID and Confirmation Code, but even if you didn’t receive one or lost it, you can still submit a Claim here by filling out a few simple fields.
